Will Call Rental Agreement
Home » Will Call Rental Agreement
This Will Call Rental Agreement (“Agreement”) is between Tlapazola Event Rentals LLC (“Tlapazola”) and the individual or business identified on the accepted order (“Renter”). It applies when the Renter picks up rental equipment from Tlapazola.
Pickup and return location:
1545 W 134th St
Gardena, CA 90249
The accepted quote or order confirmation identifies the equipment, rental charges, pickup and return times, and security requirements. This Agreement and the accepted order together govern the rental. Any exception must be expressly confirmed by Tlapazola in writing.
ACCEPTANCE OF AGREEMENT
The Renter accepts this Agreement by signing it, accepting it during online checkout, or expressly confirming the order and making payment after these terms have been provided. A pickup acknowledgment may also be required before equipment is released.
A person accepting an order on behalf of a business or organization represents that they are authorized to do so. The Renter is responsible for providing accurate order and contact information.
PAYMENT AND PICKUP REQUIREMENTS
All rental charges must be paid in full by the due date stated on the accepted order and before equipment is released. Any booking deposit is credited toward the order total.
Tlapazola accepts major debit and credit cards and cash for rental payments. Checks, prepaid cards, and gift cards are not accepted. A suitable debit or credit card is required for the security authorization even when rental charges are paid in cash.
The person collecting the equipment must provide a valid photo ID and be the Renter or an authorized pickup representative. Tlapazola may retain a copy of the ID for rental verification, subject to its Privacy Policy.
Tlapazola may withhold release or cancel an order if payment is overdue, required identification or security authorization is missing, or essential order information remains incomplete. The applicable cancellation terms govern rental payments already received.
TEMPORARY SECURITY CARD HOLD
At pickup, Tlapazola places a temporary authorization hold on an accepted debit or credit card. This hold is separate from rental payments and is not an additional rental charge.
| Will Call Rental Total | Security Deposit Amount |
|---|---|
| $1 to $100 | $200 |
| $101 to $200 | $250 |
| $201 to $300 | $300 |
| $301 to $400 | $350 |
| $401 to $500 | $400 |
For orders over $500, the required hold will be disclosed before the order is confirmed. The accepted order will identify the applicable security requirement.
After return and inspection, Tlapazola will release the unused authorization. Documented charges for missing equipment, damage, additional cleaning, late returns, or other amounts due under the accepted order may be collected as authorized by the Renter and permitted by applicable law.
Tlapazola will provide an itemized explanation of assessed charges. The security hold does not limit the Renter’s responsibility for amounts exceeding the hold.
The card issuer determines when funds become available after an authorization is released. A hold release is different from a refund of a completed payment.
Payment information is handled through Tlapazola’s payment provider in accordance with its Privacy Policy. Tlapazola does not promise deletion of records that must be retained for transaction processing, accounting, or legal purposes.
CANCELLATION AND REFUND POLICY
Cancellation timing is measured from the scheduled pickup date and time stated in the accepted order. The Renter must communicate a cancellation to Tlapazola in writing, including by email or text message.
The following schedule applies to payments for standard rental items and Services:
-
More than seven days before scheduled pickup: 90% of amounts paid will be refunded. Tlapazola retains 10% as a cancellation charge.
-
Seven days or less, but more than 24 hours before scheduled pickup: 50% of amounts paid will be refunded. Tlapazola retains 50%.
-
24 hours or less before scheduled pickup: No refund will be issued.
These percentages apply whether the Renter paid a booking deposit or paid in full. No additional credit card processing charge is added to the cancellation charge.
A temporary security card hold or separately collected refundable security deposit is not a rental payment and is excluded from the cancellation calculation.
SPECIAL AND CUSTOMIZED ITEMS
When the Renter confirms and pays for a special or customized item, Tlapazola orders or begins preparing it for that Renter. Payments attributable to that item are nonrefundable from the time it is confirmed and paid.
The item and its cost must be identified as special or customized in the quote or order confirmation before payment. Examples may include balloons, specially ordered linens or tents, helium, and propane.
Ordinary in-stock tents and linens follow the standard cancellation policy unless specifically identified as special or customized on the accepted order. The nonrefundable status of a special item does not change the cancellation calculation for unrelated standard items.
UNUSED EQUIPMENT AND EARLY RETURNS
After pickup, rental charges are not refunded solely because equipment was unused or returned early. This includes unused helium and propane.
These provisions do not eliminate remedies available under applicable law if Tlapazola fails to provide the agreed equipment or provides defective equipment.
LOADING, TRANSPORTATION, AND UNLOADING
The Renter is responsible for bringing a suitable vehicle and enough people to safely load equipment at pickup and unload it when returning it. Tlapazola recommends at least two capable people for large or heavy orders.
Tlapazola staff do not provide general loading or unloading Service. When appropriate, staff may assist by positioning a pallet at the rear of a suitable vehicle.
The Renter remains responsible for loading, securing, transporting, unloading, and returning the equipment. Staff assistance does not confirm that a vehicle is suitable or that its load is properly secured.
The Renter must provide appropriate restraints and protect equipment from movement, weather, and damage during transport. Contact Tlapazola before pickup if there is any uncertainty about vehicle capacity or transportation requirements.
Tlapazola may decline to release equipment into a vehicle or loading arrangement that reasonably appears unsafe.
INSPECTION, SHORTAGES, AND EQUIPMENT PROBLEMS
The Renter or authorized pickup representative must count and inspect equipment before leaving the facility and report shortages, visible damage, or malfunctioning items immediately. Tlapazola will inspect or test applicable equipment before release when practical.
Any known shortage or existing damage should be recorded on the pickup acknowledgment.
If a problem becomes apparent after departure, contact Tlapazola promptly while there is an opportunity to investigate and correct it. Depending on the circumstances and availability, Tlapazola may troubleshoot, repair, replace, or provide an appropriate adjustment for the affected item.
Do not continue using equipment that appears damaged or unsafe.
Reporting a problem after the rental may limit what Tlapazola can verify or correct, but does not automatically eliminate rights available under applicable law.
RENTAL PERIOD, EXTENSIONS, AND RETURNS
The accepted order states the pickup and return times. Standard pricing covers a 24-hour rental period, unless a different period is confirmed in writing.
A holiday rental may allow up to 48 hours when expressly confirmed on the order. A holiday does not automatically extend the return deadline.
The Renter must return equipment to the stated location during the confirmed return hours.
An extension must be requested before the scheduled return time and approved by Tlapazola. Approval depends on equipment availability.
An extension to an existing rental is not a rush order and does not incur a Rush Service cost. An approved extension may require an additional rental charge, which will be disclosed before acceptance.
Keeping equipment beyond the confirmed return time without approval may result in additional rental charges and reasonable recovery costs attributable to the delay. Unreturned equipment may be charged at replacement cost. Rental payments do not count toward replacement costs.
EQUIPMENT RESPONSIBILITY, LOSS, AND DAMAGE
The Renter must use, transport, protect, and store equipment with reasonable care from pickup until it is returned to Tlapazola.
The Renter is responsible for missing, stolen, or unreturned equipment and damage beyond ordinary wear while the equipment is in the Renter’s care, subject to any selected Damage Waiver and applicable law. This responsibility does not extend to damage caused by Tlapazola’s own negligence.
Repairable damage may be charged at the reasonable repair cost. Missing items and items damaged beyond repair may be charged at replacement cost. Tlapazola will provide an itemized explanation of assessed charges.
Rental payments do not apply toward repair or replacement costs. Ordinary wear from proper use is not chargeable damage.
Equipment must be used only for its intended purpose and according to instructions provided by Tlapazola.
RETURN CONDITION AND POST-EVENT CLEANING
Equipment must be returned in substantially the condition provided, allowing for ordinary use, and packed in the containers or protective packaging supplied.
Dinnerware and glassware must be rinsed free of food and repacked in the containers provided.
A Post-Event Cleaning Service charge starting at $150 applies when excessive dirt, mud, grease, food residue, or other soiling requires cleaning beyond ordinary use. Any higher charge will reflect the condition and additional work required and will be documented.
Ordinary wear and standard linen laundering do not trigger this charge. Cleaning charges do not replace responsibility for repair or replacement when equipment is damaged.
Lift equipment when moving, loading, and unloading it. Do not drag items across floors or the ground.
About Tlapazola Event Rentals in Gardena: Expertise & Team
Do not wash rented linens. Standard laundering is included in the linen rental charge.
Return linens free of tears, holes, burns, wax, gum, and stains that cannot be removed through normal laundering. Do not place wet linens in sealed plastic bags, as this may cause mildew.
Tlapazola will inspect returned linens. Missing linens or linens damaged beyond repair may be charged at replacement cost.
OPTIONAL DAMAGE WAIVER
The optional Damage Waiver costs 10% of the rental equipment subtotal. Delivery, setup, other Services, taxes, and refundable security deposits are excluded from the calculation. If selected, it appears separately on the order.
The Damage Waiver provides limited protection for minor accidental damage resulting from normal use during the rental period. It is not insurance.
It does not cover:
-
Lost, stolen, missing, or unreturned equipment.
-
Misuse, abuse, negligence, or intentional damage.
-
Weather damage, including damage caused by wind, rain, or extreme heat.
-
Excessive staining, burns, wax, or residue.
-
Damage during transportation, handling, or storage by the Renter.
The Renter remains responsible for repair or replacement costs outside this protection. Tlapazola will assess and document the condition of affected equipment, distinguishing ordinary wear from chargeable damage.
APPLICABLE LAW AND ORDER CHANGES
California law governs this Agreement, except where applicable law requires otherwise. Nothing in this Agreement waives rights that cannot legally be waived.
Changes to an accepted order must be confirmed in writing. Later website updates do not change an accepted order retroactively unless both parties agree.
RENTER ACCEPTANCE
The Renter agrees to this Agreement and the equipment, rental period, pickup and return arrangements, security requirements, and charges shown on the accepted order.
At pickup, the Renter or authorized representative acknowledges receipt of the equipment listed on the pickup record, subject to any shortages or existing damage recorded at that time.
